Dumei platform user service agreement

Before you agree to this agreement during the registration process, please read it carefully. You must carefully review and fully understand all the terms, especially those that exempt or limit liability, apply law, and resolve disputes. Key clauses will be highlighted in bold; you should read them carefully. By creating a Dumei platform account, you agree to be bound by the following terms, conditions, and notices (collectively referred to as this “Agreement”). If you do not agree with this Agreement or any of its provisions while reading it, you should immediately stop the registration process. The Dumei platform is operated by Beijing Xin’s Tourism Culture Development Co., Ltd. Specific products or services (hereinafter referred to as “products or services”) are provided by Beijing Xin’s Tourism Culture Development Co., Ltd. or qualified third-party suppliers. If you visit the Dumei platform, book, or use any of its products or services, you are deemed to have accepted the “Dumei Platform User Service Agreement” (hereinafter referred to as “this Agreement”). Please read the following content carefully, especially the bolded sections. If you disagree with any of the following, stop visiting the Dumei platform or using any products or services provided by the Dumei platform immediately. You may perform this action or terminate this agreement by closing your account and ceasing to access or use the service.)
1. General provisions
This agreement includes the main text of the agreement, individual service agreements for each sub-channel of the Dumei platform, and various rules that Dumei has already published or may publish in the future, including but not limited to disclaimers, personal information protection policies, personal information authorization statements, booking terms or notices, travel contracts, account cancellation agreements, and other agreements (hereinafter referred to as “other terms”). In case of any inconsistency between this agreement and the “other terms,” the “other terms” shall prevail. Unless otherwise explicitly stated, all products/services provided by the Dumei platform are subject to this agreement.
In this Agreement, “Dumei” refers to Beijing Xin’s Tourism and Culture Development Co., LTD., the developer and operator of Dumei platform.
In this Agreement, “Dumei Platform” refers to the web pages and clients (including App, WeChat Mini program or H5 page) whose domain name is mainly dumetravel.com. The terminal devices applicable to the client include but are not limited to PC, tablet computer, mobile phone, TV, etc.
In this agreement, “User” refers to any natural person who accesses or uses the products or services provided by Dumei Platform, including but not limited to registered users and unregistered users. Any user who has not registered for Dumei Platform’s products or services becomes our “Non-Registered User” from the moment they start using the platform’s products or services. During use, they must comply with all terms of this agreement except those specifically agreed upon for registered users.
If you visit the Dumei platform or use Dumei products or services as a user of Dumei or a partner company, you agree to all the terms of this Agreement and other terms, rules, instructions and operation guidelines published by Dumei platform.
2. Service instructions
The Dumei platform uses its own operating system to provide users with various products or services through the Internet. You must:
(1) Configure necessary Internet access devices by yourself, including but not limited to PC, mobile phone, tablet computer, etc. Personal Internet access and payment of network fees and telephone charges related to this service.
(2) In view of the importance of the products or services provided by Dumei Platform, you agree:
① Provide true, detailed and accurate personal information for account registration on Dumei platform. Do not use other people’s email address, mobile phone number or other ways to register the account under the identity of others.
② After registration, if the information changes, you should change it in time. If the information you provide does not meet the requirements of legality, truthfulness, accuracy and completeness, you shall bear the corresponding responsibilities and consequences caused thereby, and Dumei platform reserves the right to terminate your use of various products/services.
3. Modification of service agreement
According to changes in China’s national laws and regulations, operational needs, or to improve service quality, Dumei Platform will, when necessary, make timely modifications or updates to this agreement and/or various rules, and will announce or notify on the relevant pages of the Dumei Platform website or mobile app in advance. The modified/updated text will take effect on the date specified in the relevant update notice, but Dumei commits to announcing or notifying at least seven days before the text takes effect.
You should promptly review and understand the relevant modifications or updates. If you disagree with the modifications or changes, you have the right to contact Dumei Platform before the effective date of the change for feedback. If your feedback is adopted, Dumei will make appropriate adjustments to the changes. If you still disagree with the effective modifications or changes, you may stop using the services involved in these changes; in this case, the modifications or changes will not take effect on you. If you continue to use the services after the implementation of the aforementioned modifications or changes, it will be considered that you have agreed to all the modifications or changes.
4. Service change, interruption and termination
You fully understand and agree that this service involves internet and mobile communication services, which may be affected by various unstable factors. Therefore, any risks of service interruption, cancellation, or termination due to force majeure, computer viruses or hacker attacks, system instability, user location, user device being powered off, internet connectivity, communication lines, personal travel documents, or other reasons beyond the control of Dumei Platform, will not be compensated by Dumei within the scope of the law.
You fully understand and agree that, except as otherwise provided in this Service Agreement, due to the special nature of online services, Dumei Platform may change, interrupt, or terminate part or all of its online services. Except for products/services you have already ordered or applied for through the Dumei platform and for which payment has been completed and confirmation of order or application has been received, Dumei shall not be liable for any changes, interruptions, or terminations of services. However, Dumei should notify you in advance as much as possible and provide you with time to handle related rights and interests.
5. User behavior standards
When using the products or services of Dumei Platform, you must comply with the relevant laws and regulations of the People’s Republic of China. You promise not to use the products or services of Dumei Platform for any illegal or improper activities, including but not limited to the following behaviors:
(1) Upload, display, post, disseminate or otherwise transmit, access the Dumei Platform or use the Dumei products or services for any illegal purpose, or use the Dumei Platform to engage in the following activities without permission, containing information with one of the following contents:
① Those who oppose the fundamental principles established by China’s Constitution; endanger China’s national security, leak state secrets, subvert the state power of China, or undermine China’s national unity; damage the honor and interests of the state; incite ethnic hatred, ethnic discrimination, or disrupt ethnic unity; undermine China’s state religious policies, promote cults and feudal superstitions; contain any other content that is restricted or prohibited by Chinese laws, regulations, rules, ordinances, and any norms with legal effect.
② Spreading rumors, disturbing social order or undermining social stability; spreading obscenity, pornography, gambling, violence, murder, terror or inciting crimes;
③ False, illegal, misleading, defamatory, obscene, pornographic, indecent, obscene, suggestive, harassing (or promoting harassment of others), threatening, infringing privacy or image rights, abusive, inciting, discriminatory, offensive, fraudulent or other objectionable content;
④ May cause minors to imitate unsafe behaviors or violate social ethics, induce minors to develop bad habits, etc.;
⑤ is any third party’s private information, including but not limited to address, telephone number, email address, national insurance number and credit card number. Please note that an individual’s surname (surname) may be published on our website, provided that the identified individual has given express permission in advance;
⑥ Impersonating any person or entity, or otherwise distorting your relationship with a person or entity (including the Dumei platform).
(2) Acts that disrupt the trading order of the Platform, including but not limited to:
① Purchase services/products beyond real life consumption needs;
② Malicious order, malicious rights protection, false transactions, etc.
The occurrence of the aforementioned actions will be deemed as a fundamental breach of this agreement. In any case, if Dumei Platform reasonably determines that you have or may have engaged in such actions (including through technical rule-based detection and verification), it can delete any information you disseminate or spread at any time without prior notice, and suspend or terminate the provision of Dumei Platform’s products/services to you. You are responsible for your actions when accessing or using Dumei Platform or its products/services.
6. Intellectual property rights
The intellectual property rights of the content used or generated in the products/services provided by Dumei (including but not limited to products, web pages, text, images, audio, video, data, and information) belong to Dumei. The intellectual property rights owned and enjoyed by Dumei do not transfer due to any use by you. Without Dumei’s prior written consent, you may not use the aforementioned content in any form or create related derivative works, except if you are the rights holder of the work, have obtained authorization from the relevant rights holder, or there is another agreement between Dumei and you.
You commit that the content you post and upload through the Dumei platform (including but not limited to text, images, videos, audio, and other forms of content) is original or has been legally authorized. The intellectual property rights of the uploaded content belong to you or the relevant right holders. You are responsible for the content you post and upload through the Dumei platform. If the content you send or spread is illegal, violates laws, or infringes on others ‘rights, Dumei has the right to independently determine and take measures such as deletion, blocking, or disconnecting links. In case of disputes arising from the infringement of others’ intellectual property rights, you must bear full responsibility. If your actions cause losses to Dumei, Dumei has the right to demand compensation from you according to the law.
You commit that for the content you upload, publish, or transmit through the Dumei platform (including but not limited to products, web pages, text, images, audio, video, data, and information), you grant Dumei and third parties designated by Dumei a global, free, perpetual, non-exclusive, and sublicensable right (including but not limited to the rights to reproduce, translate, disseminate via information networks, adapt, create derivatives, perform, display, show, film, produce, distribute, and related commercial development, promotion, and marketing rights). The scope of Dumei’s use of the content includes, but is not limited to, the Dumei platform or other websites, applications, products, or terminal devices designated by Dumei.
You confirm and agree that Dumei authorizes Dumei to protect the rights of the content you upload and publish with intellectual property rights in its own name or by entrusting a professional third party to do so. The forms of rights protection include but are not limited to: monitoring infringement, sending letters of rights protection, filing lawsuits or arbitration, mediation, settlement, etc. Dumei has the right to make decisions on matters of rights protection and implement them independently.
7. Protection of users’ personal information and privacy rights
Respecting users ‘personal information and privacy is the basic policy of Dumei. In the process of using Dumei’s products/services, Dumei will adopt relevant technical measures and other security measures to protect your personal information and privacy.
Dumei attaches great importance to the protection of minors’ personal information and privacy, therefore:
⑴ If you are under the age of 18, you must obtain your guardian’s consent to use the Dumei platform. If you have not obtained the guardian’s consent, the guardian can notify the Dumei platform to handle the relevant account. The Dumei platform has the right to restrict the functions of the related account (including but not limited to browsing, posting information, and interactive communication).
⑵ We place great importance on the protection of minors ‘personal information and privacy. We particularly remind you to enhance your awareness of protection when filling out minors’ personal information and to be cautious about posting content that includes minors. You should obtain the consent of the rights holder to display minors’ images, voices, and other information, and allow us to use and process such content related to minors according to this agreement. If the content infringes upon the rights of minors, we have the right to handle it upon receiving notification from the rights holder or based on other considerations to protect the legitimate rights and interests of minors.
⑶We will work together with guardians to protect the physical and mental health of minors. If you are a guardian, you should also fulfill your duty to supervise minors, pay attention to their online safety, and guide them to use the internet in a healthy and reasonable manner. Minors should learn to use the internet correctly under the supervision and guidance of their guardians, within a reasonable scope, develop good online habits, and avoid becoming addicted to virtual cyberspace.
⑷ Teenagers must abide by the National Youth Internet Civilization Convention.
⑸ Special tips for guardians
① If you apply for a Dumei platform account as a guardian, we have the right to assume that you have obtained your consent.
② As a guardian, please keep your payment device, payment account and payment password, so as to avoid the ward using payment functions through your account without your consent.
8. Registration and use of Dumei platform account
You can create a Dumei platform account to use the products/services of Dumei platform. You can register directly with your mobile phone number and email address on Dumei platform.
After successfully registering a Dumei platform account, you can also use the Dumei platform account to log in to some products/services of Dumei’s partners through authorized login and other methods. However, please note that when you log in to the products/services of partners through the Dumei platform account, you should also abide by the account use rules of relevant partners.
You are entitled to limited use of the Dumei Platform account. Your account can only be used for personal purposes other than commercial purposes, and you may not transfer, lease, lend, sell, share or otherwise use it to others (except as otherwise provided by law or expressly agreed or authorized by Dumei).
9. Account security
The Degree platform only provides this service to adults who have the ability to pay. If you are under the age of 18, you should use this service with the participation of your parents or guardians.
According to the page prompts, after successful registration, you can set your account password according to the password rules. If you use Dumei platform services, you should understand that these services have a platform nature and that there may be changes in funds under this service. You agree to maintain and manage the confidentiality of your account and password with a stricter attitude than ordinary services, and to restrict third parties from using or accessing your computer or mobile device. Furthermore, you explicitly agree to bear responsibility for all activities conducted under your account and password. If you fail to properly safeguard your password, you will bear full responsibility for any consequences resulting from it. Except when Dumei is at fault, you are responsible for all outcomes of actions taken under your account (including but not limited to signing various agreements online, posting information, purchasing goods and services, etc.).
In addition, to enhance the convenience of customer service, when users bind their account with a phone number or email to contact Dumei’s customer service, or use other numbers such as order-related numbers to call the customer service hotline and pass through Dumei’s identity verification, Dumei will assist in executing relevant operations for the order. Therefore, please keep your mobile phone safe and set necessary security measures to prevent the leakage of order information. If the leakage of order information and other consequences occur due to reasons not attributable to Dumei (for example, if your phone is stolen or if you have not set up necessary encryption measures on your phone, leading to unauthorized access to Dumei platform order information, allowing others to impersonate you and use the information to access the Dumei platform and customer service), even if you believe that the actions were not taken by you, Dumei will not be liable for any resulting consequences. You acknowledge and agree that if Dumei reasonably deems your account to pose a security risk, including but not limited to: (1) the aforementioned scenarios; (2) theft of the account or bank card number; (3) the payment card or other payment channels being in any abnormal state (not limited to: risk control, fraud prevention, restrictions or suspension of card usage, etc.); (4) third parties claiming that you have infringed upon their legitimate rights and interests and providing valid proof; (5) other situations determined by the platform to involve transaction risks, Dumei has the right to immediately suspend or cancel transactions at risk (including but not limited to completed transactions), restrict account functions, or terminate or stop providing you with Dumei platform products/services. If you have any objections to these actions, you may contact Dumei through the contact information published in this agreement. You acknowledge and agree that you have the legal rights and responsibilities for activities, actions and events conducted through your account. You may not transfer your account in any form, authorize others to use your account or trade your account with others.
10. The particularity of cancellation and refund
Unless otherwise specified, the products provided on the Dumei platform are mainly travel services or products, which have strong time sensitivity and other characteristics. They cannot be subject to online return policies such as a seven-day return policy like ordinary online goods. Please read the specific terms for ordering and canceling related products carefully. For users in the UK and EU, if we make any changes to our services that we reasonably believe will have a significant negative impact on your access or use of these services, we will notify you at least 30 days in advance of these changes. If you do not terminate your contract with us before these changes occur, we will consider it as your acceptance of these changes.
11. Special Note
You should ensure that the traveler’s physical condition is suitable for the vacation package you have booked. If the traveler is over 60 years old, pregnant, or has a history of heart disease, hypertension, respiratory diseases, etc., please travel only after obtaining the consent of a professional doctor from the hospital and family members. You should choose your travel activities based on your own health condition, fully understand the content of the tour, and strictly adhere to the safety regulations of the tour.
You shall ensure that the documents, communication methods and other relevant information you provide are true and valid. When you book a trip or use the service to plan an international trip, you are responsible for ensuring that you meet all entry requirements and that your travel documents (including but not limited to passports and visas) are complete.
During your trip, you should respect the local religious beliefs, national customs and local conditions, and consciously protect the local natural environment.
During the trip, in order to obtain more comprehensive protection, Dumei platform suggests that you take out relevant insurance according to your personal wishes and needs.
The DegreeMe platform has the right to charge you for booking and purchasing travel products.
In order to ensure the smooth confirmation of your reservation and purchase of products, Dumei platform has the right to obtain your personal necessary information, and will only use the personal necessary information provided by you for product reservation and purchase services. Dumei platform will keep your personal data confidential and properly keep all certificates submitted by you.
If you are a tourist with a non-Chinese mainland passport or a self-provided visa, you should apply for the travel visa and related documents by yourself.
12. Third party links and business marketing
The products/services on the Dumei platform may provide links to other internet websites or resources. Dumei will fulfill its obligations to advertisers in accordance with legal requirements. However, you acknowledge and agree that these advertisers and their content are not under Dumei’s control. You should exercise caution in assessing the authenticity and reliability of the advertising information. Any actions you take through the products/services of the Dumei platform with advertisers or ad publishers, or any disputes arising therefrom, shall be your own responsibility to resolve. Except for responsibilities stipulated by laws and regulations that fall on the advertiser, Dumei does not assume any additional liability but will provide necessary assistance as required by law.
While visiting Dumei platform or using products/services, you agree to accept all kinds of information push services provided by Dumei platform, including but not limited to email push and other service and marketing information.
13. Law
The concepts and definitions involved in this Agreement are consistent with the same concepts and definitions in the laws of the People’s Republic of China. Any dispute arising from the booking of any product or use of any service through Duomei Platform may be settled by both parties through negotiation; if no agreement can be reached through negotiation, either party may file a lawsuit to the Fengtai District People’s Court of Beijing.
For disputes related to the Dumei platform, you fully understand and agree to the use of small claims procedures for civil cases that meet the criteria for small claims, with a one-instance final adjudication. Matters concerning the trial organization, trial duration, trial method, and one-instance final adjudication in cases tried under the small claims procedure shall be governed by the “Pilot Implementation Measures for Reforming the Complexity and Simplification of Civil Litigation Procedures” issued by the Supreme People’s Court.
Special advice for international use
You understand that the Internet has the characteristics of cross-border browsing and agree to comply with all local laws and regulations regarding online behavior and content. You specifically agree to comply with all laws and regulations related to the dissemination of Internet information in China or your country or region.
